Terms of Use

These terms govern your use of DeltaGuard Global Auctions (the "platform"), operated by the company named, with its registered office, on our Contact page ("DeltaGuard", "we", "us"). By creating an account or using the platform you agree to these terms, our Auction Policy, Refund and EMD Policy, Privacy Policy and Grievance Redressal Policy, which together form the agreement between you and DeltaGuard. If you use the platform for a business, you confirm that you are authorised to bind it. 1. What DeltaGuard does DeltaGuard runs an online marketplace where sellers offer assets such as machinery, vehicles, property and surplus stock, and verified buyers bid for them in timed auctions. We verify participants, review listings, run the auctions and record each transaction. We are not the seller or the buyer of any asset, we do not own the assets listed, and we are not a party to the contract of sale between seller and buyer. 2. Who can use the platform You must be at least 18 and able to enter into a binding contract under Indian law. Businesses must be validly registered. We may ask for identity and business documents (KYC) at any time, and we may refuse, limit or close an account where we cannot verify it or where we reasonably suspect misuse. 3. Your account You are responsible for keeping your password safe and for everything done through your account. Tell us at once if you think someone else has used it. The information you give us, including your bank account details, must be true and kept up to date. 4. Selling To list an asset you need an active seller membership. You must own the asset or be authorised to sell it, have the right to transfer it free of undisclosed charges, and your description, photographs and documents must be accurate. Every listing is reviewed by DeltaGuard before it can go to auction, and we may ask for documents, an inspection or changes, or decline a listing. Before an auction is published, you pay the Validation Fee set for it and any verification and inspection fees that apply. DeltaGuard decides the earnest money deposit for each auction. You may not bid on your own listing, or have anyone bid on it for you. 5. Buying and bidding To bid you must register for the auction and, where it requires one, pay the earnest money deposit, which DeltaGuard verifies before you can bid. By registering you accept the conditions of sale for that auction, including that every bid you place is an irrevocable offer to buy at that price, which you cannot withdraw once it is accepted by the platform. The auction rules are set out in our Auction Policy. 6. Fees and taxes Membership, validation, verification, inspection, buyer and seller fees are shown before you pay them and are itemised on your invoice or receipt. GST is added where it applies. Where the law requires DeltaGuard to collect or deduct tax at source from an amount payable to you, we will do so and give you the details. Fees are not refundable except as set out in our Refund and EMD Policy. 7. Payments Payments are made by bank transfer to the account DeltaGuard shows you, with the reference and proof of transfer, and count only once DeltaGuard has verified them against its bank account. Online payment may be offered later. DeltaGuard pays sellers only into a bank account in their own name that we have verified. We never ask for your password or a one-time password by phone or email. 8. What you must not do You must not: - bid without intending to complete, or bid on a lot you are selling or acting for; - agree with other bidders to hold prices down, or otherwise rig an auction; - give false information or documents, or impersonate anyone; - list stolen goods, or assets you are not entitled to sell, or goods whose sale is prohibited by law; - upload anything that is defamatory, obscene, invasive of privacy, harmful to children, hateful, misleading, infringing on anyone's intellectual property, or that contains malware or threatens the security or sovereignty of India, or is otherwise unlawful; - interfere with the platform, its security, or other users' accounts; - use the platform for money laundering or any other unlawful purpose. We may remove content, void bids, cancel a sale, forfeit a deposit, suspend or close accounts, and report matters to the authorities where we find such conduct. We remind users of these rules at least once a year. 9. Content and intellectual property You keep ownership of what you upload and allow us to use it to run and promote the platform. The platform itself, including its design, software and name, belongs to DeltaGuard. 10. Our responsibility We take reasonable care in verifying participants and reviewing listings, but we do not guarantee the condition, title, value or suitability of any asset, or that a buyer or seller will complete. Assets are sold as described in their listing and any inspection report, and buyers should inspect before bidding. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you for any claim is limited to the fees you paid us in connection with the transaction concerned. Nothing in these terms limits liability for fraud, wilful misconduct, or anything that cannot be limited by law. 11. Indemnity You agree to compensate DeltaGuard for any loss, claim or penalty that arises from your breach of these terms, your listing, or your breach of any law. 12. Events outside our control We are not responsible for delay or failure caused by events we cannot reasonably control, such as natural disasters, war, government action, or failure of banks, networks or power. If such an event affects a running auction, we may pause, extend or cancel it. 13. Suspension and closing an account You may close your account once nothing is outstanding on it. We may suspend or close an account for breach of these terms, for non-payment, or where required by law. Obligations arising before closure, such as a sale you have won, continue. 14. Changes to these terms We may update these terms. The new version is published on this page with its effective date. If you continue to use the platform after it takes effect, you accept the new version. 15. General If any part of these terms is found invalid, the rest continues to apply. You may not transfer your account or rights to anyone else. We send notices to the email address on your account, and you can reach us through the details on our Contact page. 16. Law and disputes These terms are governed by the laws of India. Please raise any complaint first through support or with our grievance officer, as described in our Grievance Redressal Policy. Courts having jurisdiction over DeltaGuard's registered office have exclusive jurisdiction, subject to any right you have under consumer protection law.
